Galaxy Service Terms of Service and Privacy Policy

Definitions

"Galaxy Service”: any one of the Galaxy sites provided to you by the Galaxy Project, including but not limited to:

"Data": is any information stored in the Galaxy service, be it from form input, file uploaded to the service, fetched from an external site, or by any other means.

"Operators": Any personnel whose duties involve the administration, operation, and support of the Galaxy Service. This includes, but is not limited to: system administrators, software developers, and support personnel.

Use of Service

The Galaxy Service is a free, public, Internet accessible resource (the "Service"). Data transfer is encrypted. Data storage is not encrypted. The Operators of the Service use reasonable security measures to protect against the loss, misuse, and alteration of the information and Data under our control. However, no method of transmission over the Internet or method of electronic storage is 100% secure or reliable. If there are restrictions on the way your research data can be stored and used, please consult your local institutional review board or the project principal investigator before uploading it to any public site, including this Service. If you have protected data, large data storage requirements, or short deadlines you are encouraged to set up your own local Galaxy instance and not use this Service. Your access to the service may be revoked at any time for reasons deemed necessary by the Operators of the Service ("Operators").

You are strictly prohibited from making use of the Galaxy Service for the storage or processing of any Data that can be classified as Personally Identifiable Information (PII) Data, Health Insurance Portability and Accountability Act (HIPAA) Data, or Federal Information Security Management Act (FISMA) Data, as classified by the United State Government, including but not limited to potentially personally identifying medical data.

You acknowledge that you are responsible for compliance of all of your data processing activities carried out on the Galaxy Service with applicable laws and regulations of the United States of America, as well as any laws or regulations of other legislations or any other restrictions that might be applicable due to the provenance, intended use, legal ownership of or any licensing or other legal restrictions imposed on the data being processed.

Information collected and use of information

The Galaxy Service does not require you to identify yourself while using the Service. The Service does not collect your Personally Identifiable Information (PII) except that information which you choose to provide to the Service, but we automatically collect and store general information about you and your visit to the Service, but that information does not identify you personally unless you choose to provide your personal information. The information that we collect is used to track how users interact with the Service, so that we can improve the user’s experience and make other improvements to the Service. Accounts and Service Limitations

You may choose to register an account with the Service. Your registration data is primarily used so you may persistently store data on the Service and use advanced Galaxy features such as sharing and workflows. The operators of the Service will not provide your registration data to any third party unless required to do so by law. Your access to the Service is provided under the condition that you abide by any published quotas on data storage, job submissions, or any other limitations placed on the public Service. Attempts to subvert these limits by creating multiple accounts or through any other method may result in termination of all associated accounts.

By creating an account, you agree to allow the Operators to send administrative e-mail messages as necessary for the continued health and stability of the Service, or in the investigation and resolution of abuses of the Terms of Service. You may cease reception of administrative e-mail messages by deleting your Galaxy Service account.

Cookies

A cookie is a unique identifier given to a web browser by a web server. Each time the browser requests a page from the server, this identifier is sent back. The Galaxy Service provided uses cookies to identify users/computers in order to maintain user sessions (e.g. to provide/maintain analysis results while you browse the website). Usage of cookies is in no way linked to any personally identifiable information about individual users. The information is also not shared with any third party. Information that we gather from cookies is not linked to any of your personally identifiable information while using the Service, unless you choose to provide your personal information (e-mail address and username) when registering an account. Most browsers are set to automatically accept cookies. If you prefer not to receive cookies, you may set your browser to warn you before accepting cookies or you may also refuse all cookies by turning them off in your browser. However, please be aware that in case of not accepting cookies, the functionality of our website is limited.

Google Analytics

We may use Google Analytics, as well as other similar tools, as service quality and statistical needs arise, to help analyze how users interact with the Service. The third-party tools typically utilize cookies but may also use pixel gifs or beacons. The information generated by the cookie and/or beacons about your use of the Service is transmitted to these tools. This information is then used to evaluate visitors' use of the Service and to compile statistical reports on activity for our websites.

We may use Google Analytics to aggregate and track non-identifiable visitor information for Google Analytics Demographics and Interest Reporting.

Google Analytics also provides you with the ability to modify and delete the information that Google tracks for remarketing purposes by visiting Google's ad settings page. You can also disable collection of any demographic data on that page.

THE ENTIRE RISK AS TO THE QUALITY OF THE SERVICE IS WITH YOU. This DISCLAIMER OF WARRANTY constitutes an essential part of this service agreement.

Limitation of Liability

Under no circumstances and under no legal theory, whether in tort (including negligence), contract, or otherwise, shall The Pennsylvania State University, The University of Texas at Austin, or any other entity which provides resources for the Service be liable to anyone for any indirect, special, incidental, or consequential damages of any character arising as a result of the use of this Service including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses. This limitation of liability shall not apply to the extent applicable law prohibits such limitation.
